Bill, the current President of the Fairfax (VA) Bar Association, has spent the past 25 years with the firm building a civil litigation practice in the local, state and federal courts in Virginia.
Bill’s typical client is either a plaintiff or a defendant in a civil suit involving anything from a contract dispute to landlord-tenant interactions, defamation claims, breaches of confidentiality agreements and a wide variety of damage claims. He represents both individuals and businesses; many condominium boards and homeowners’ associations, as well as property owners, have retained him to work on matters arising from multiple-ownership community issues. Common examples include easements, annexation of additional property, disputes with developers and construction defect claims against builders.
A key specialty of Bill’s is working with condominium and HOA boards on the scope of Board authority when dealing with virtually any fact pattern. A common situation would be a homeowner who violates a Board policy by building a fence without permission; the violation may prompt a suit to enforce the covenants or when the owner tries to sell the property, the “illegal” fence could prevent the sale. As Bill has noted, an apparently simple situation can involve an entire HOA: for example, adopting a parking policy can run into questions of personal or constitutional property rights, while citing one homeowner for an HOA violation can raise the defense that other owners were allowed to “get away with” a similar violation. Boards can also be challenged as to their legitimacy on grounds that range from improper elections to accidentally violating the Virginia Property Owners’ Association Act or the Virginia Nonstock Corporation Act. Bill has successfully handled such cases all the way to the Virginia Supreme Court.
In addition, Bill has worked with individuals on estate planning and estate administration throughout his career.
